Acting for Vulnerable Clients – An Opportunity for Law Firms

Brooks Macdonald are a discretionary fund management company who are working with Armstrong Watson to promote the best routes to financial advice and investment management for vulnerable clients.

There is a growing regulatory focus on service provision to vulnerable clients across a wide range of industries, from communications and energy to legal and financial services.  Vulnerable clients often struggle to comprehend the solutions they are paying for.  This is a key theme for the Financial Conduct Authority (FCA) and the Solicitors Regulation Authority (SRA) as they focus more sharply on an ageing population and vulnerability in general.

This presentation covers factors to consider for law firms in acting for vulnerable clients, whether due to age; mental capacity; or when acting as a Court of Protection appointed Deputy.   This can be a growth area for law firms as the number of such clients increase, but also as a differentiating factor to other providers.  The market opportunities will be put into context alongside the changing regulatory backdrop around working alongside other professionals in acting for vulnerable clients, particularly in relation to new referral arrangement requirements.  

The UKs ageing demographic means that the number of vulnerable clients seeking complementary legal and financial services is set to increase, and many will be affected by circumstances making them susceptible to detriment.  Where advisers can work together, signposting appropriately skilled advice to support such clients, they open an opportunity for regular and renewed referrals and the chance to add significant value to the client service experience.


Speaker Profile – David Mulholland

David joined Brooks Macdonald in 2017 and supports and develops intermediary relationships throughout the UK.  He is also responsible for the distribution of the Brooks Macdonald Personal Injury & Court of Protection Service.

Prior to joining Brooks Macdonald, David worked as an Investment Consultant, and at Aviva UK Life and Pensions as a Sales Consultant. He has over 20 years’ experience working in sales in the financial services industry.
